Washington, DC, October 20, 2009 -- LCA welcomes yesterday ’s ruling by the Massachusetts Supreme Judicial Court that allows a class action lawsuit filed in 2006 against the cigarette maker Philip Morris USA Inc., to go forward in federal court.
While the process could take years, if the lawsuit is successful, Philip Morris USA, Inc. could be required to pay the cost of monitoring and screening smokers and former smokers in order to detect lung cancer at an early curable stage.
Today’s ruling, while directed toward updating Massachusetts’ liability law, has the potential of providing victims of big tobacco a powerful weapon to help prevent death – by earlier detection.
